PREAMBLE
For God and Country, we associate ourselves together for the following purposes:
To uphold and defend the Constitution of the United States of America; to maintain law and order; to foster and perpetuate a one hundred percent Americanism; to preserve the memories and incidents of our associations in the Great Wars; to inculcate a sense of individual obligation to the community, state and nation; to combat the autocracy of both the classes and the masses; to make right the master of might; to promote peace and good will on earth; to safeguard and transmit to posterity the principles of justice, freedom and democracy; to consecrate and sanctify our comradeship by our devotion to mutual helpfulness.
MISSION STATEMENT
The mission of the Department of Georgia American Legion Riders is to promote and support the aims and purposes of The American Legion.
- The rehabilitation of all disabled veterans;
- Care of the dependents of those who have answered the final call;
- Care of those who are suffering from wounds, disease and want;
- The education of our children;
- Service to the community, state and nation.
American Legion Riders are Legionnaires, Auxiliary, and Sons of The American Legion who share a passion for riding motorcycles. We support the values of The American Legion by riding in patriotic parades, funeral escorts, and participating in programs, events and other ceremonies in the communities in which we live, work, and play. American Legion Riders have an unwavering respect for our country, our flag, and for those who risk their very lives for America’s freedom and security.
ARTICLE I – NAME
The name of this program shall be “The American Legion Riders, Department of Georgia”.
ARTICLE II – NATURE
Section 1. The American Legion Riders of Georgia (hereafter "ALR"), is a program of The American Legion, Department of Georgia (hereafter referred to as Department or DOG) and subject to the rules, regulations, policies, oversight and control thereof. Such oversight and control shall be exercised through an Executive Board of the Department to be known as the DOG ALR Executive Board.
Section 2. The ALR upholds the aims and purposes of The American Legion as well as conforms to and abides by the regulations and decisions of the National, Department, District, and Post organizations.
Section 3. The ALR maintains and protects the image of The American Legion at all times through appropriate wearing of The American Legion Emblem. The emblem of The American Legion demands, "that the wearer shall ever guard the sanctity of home and country and free institutions.”
Section 4. All members of the ALR shall absolutely avoid any perception of being a motorcycle club or gang. We are an American Legion Family organization whose purpose is to serve our veterans.
ARTICLE III - ORGANIZATION
A – DEPARTMENT
Section 1. The DOG ALR Executive Board shall consist of the DOG ALR Director and the three (3) DOG ALR Assistant Directors.
Section 2. The Department Commander will appoint the DOG ALR Director.
Section 3. DOG ALR Assistant Directors will be appointed by the DOG ALR Director with concurrence of the Department Commander.
Section 4. The DOG ALR Executive Committee shall consist of the Director, the three Assistant Directors, District ALR Directors, and the immediate Past DOG ALR Director.
B – DISTRICT
Section 1. The District Commander will appoint the District ALR Director.
Section 2. The District ALR Executive Committee shall consist of the District ALR Director, immediate Past District ALR Director, and each Post ALR Director within the District’s jurisdiction.
C – POST
Section 1. Any Post of the Department may establish a local ALR Chapter by application for same to the DOG ALR Director with verification of member’s eligibility. Each Chapter exists at the discretion of the sponsoring Post/Department.
Section 2. Upon establishment of a Post ALR Chapter, the Chapter Director, shall submit a copy of the Chapter Constitution, By-Laws, and Chapter Officer Certification Form to the DOG ALR. All documents must be approved by the Post Executive Committee prior to submission. The Post will review its existing liability coverage with its insurance advisers to ensure that the addition of the Chapter does not expose the Post to undue risk.
Section 3. All approved Chapters will be subject to all applicable provisions of the Department ALR Constitution and By-Laws. Chapters found in violation will be suspended.
Section 4. There will be no other official organizations of ALR at the Department, District, or Post level.
Section 5. A minimum of five (5) qualifying Legion Family members shall be needed to start a Chapter.
Section 6. The Chapter Officers and Chapter Executive Committee are responsible and accountable to the sponsoring Post Commander and Executive Committee.
Section 7. Amendments to the Chapter Constitution and By-Laws will be in accordance with the sponsoring Post Constitution and By-Laws and a copy will be sent to the DOG ALR Executive Board.
ARTICLE IV - MEMBERSHIP ELIGIBILTY
Section 1. Eligibility for membership in the ALR shall be as prescribed by the National Constitutions of The American Legion, the American Legion Auxiliary, and the Sons of The American Legion.
Section 2. All members of the ALR must further demonstrate current individual membership in The American Legion, the American Legion Auxiliary, or the Sons of The American Legion.
Section 3. Individuals that are members of an American Legion Post not having an existing Chapter, may apply for membership to another Chapter. That Chapter must receive approval from the sponsoring American Legion Post that the qualifying individual or individuals may become a member of their Chapter. The sponsoring Chapter membership must also approve of, by majority vote, all applicants seeking Chapter membership from Non-Chapter Posts.
Section 4. It is understood and acknowledged that members joining a Chapter under article IV section 3 can remain a member of that Chapter until such time a Chapter is formed at the member’s home Post. At that time, they must return to their home Post Chapter or transfer their Legion Family membership to the Post where they are currently a Chapter member.
Section 5. Members will not at any time hold membership in more than one Chapter.
Section 6. There shall be no form or class of membership except an active membership, and dues shall be paid as required by the Chapter or by the Department. There are no national dues. Honorary or Associate membership in a Post ALR Chapter is forbidden.
Section 7. Each ALR member shall establish and maintain membership by being the registered owner of a street legal motorcycle (“two (2) wheeled” or “three (3) wheeled”) or be the legally registered owner’s spouse or partner within the state of registration. Additionally, child/grandchild (under 18 years old) of the legally registered owner member is qualified for membership at the same Chapter.
Section 8. All DOG ALR operators must have the following up to date and legal requirements:
- Current motorcycle insurance
- Current driver’s license with a motorcycle endorsement
- Motorcycle operator learner permits not to exceed one year are allowed provided all restrictions of said permit are adhered to.
- All members will obey the motor vehicle laws in any state in which they are operating a motorcycle or riding as a passenger.
Section 9. Chapters may allow for continued membership for those members who have given up motorcycle ownership because of age, illness, injury, or other reasons outside the member's control.
Section 10. Each Chapter shall be the judge of the qualifications of its own membership, subject only to the restrictions of this Constitution and By-Laws.
Section 11. Chapter Membership dues (provided dues are required):
- Will be current from January 1st to December 31st.
- A member whose dues for the current year have not been paid by January 1st shall be classed as delinquent. If their dues are paid on or before February 1st, they shall be automatically reinstated. If they are still delinquent after February 1st, they shall be suspended from all privileges. If they are still under suspension on June 30th of current year, their membership in the Chapter shall be forfeited.
- Post ALR Chapter members who are unable to pay dues because of active duty deployment overseas are exempt from this provision until 90 days after their return to the United States.
Section 12. A member so suspended or whose membership has been forfeited may be reinstated to active membership in good standing by vote of the Chapter ALR and payment of current dues for the year in which the reinstatement occurs.
ARTICLE V - CHARTER MEMBERS
Members who joined the chapter prior to the presentation of its Permanent Charter shall be known as Charter Members. The Permanent Charter was presented on 30 November 2015.
ARTICLE VI - AMERICAN LEGION RIDER REGALIA
Section 1. The Legion Riders Back Patch, as copyrighted and sold by The American Legion Flag & Emblem Sales, is authorized for wear by all current members of the ALR.
Section 2. As a member of the ALR, no other back patch or back patch design is authorized for wear at ALR meetings, gatherings or functions.
Section 3. The Department ALR standards for patch sales shall be on file with The American Legion Flag & Emblem Sales.
Section 4. Use of rockers or patches “physically attached” to the ALR back patch is not allowed due to trademark laws.
Section 5. The formal headgear worn at all DOG ALR meetings, gatherings or functions will be the ALR beret or the black ALR Ball Cap with The American Legion Rider embroidered emblem on the front.
Section 6. All approved ALR merchandise is available through The American Legion Flag & Emblem Sales, no other wear or use of The American Legion Emblem is authorized without formal approval of the Department and National Organizations.
ARTICLE VII - POST CHAPTER ELECTED OFFICERS
Section 1. The minimum required officers of the Chapter will be Director, Assistant Director, Treasurer, Secretary and Sergeant-at-Arms. A Road Captain, Activities Officer, Safety Officer, Judge Advocate, Chaplain, Historian and such other officers as the Chapter determines necessary may be elected or appointed by the Director with membership approval.
Section 2. The office of Treasurer and shall be surety bonded.
Section 3. All elections shall be by ballot and the candidate for each office receiving the highest number of votes shall be elected to the respective office.
Section 4. Only members in good standing with the Legion Family to include the ALR are eligible for any office of the Chapter.
Section 5. Elections are not valid until approved by vote of the Post general membership or the Post Executive Committee or the newly elected officers are installed by a Post officer during an appropriate ceremony.
ARTICLE VIII - FINANCE
A – DEPARTMENT
The revenue of the DOG ALR program shall be derived from such sources as may be approved by the DOG ALR Executive Committee in accordance with Department policy.
B - DISTRICT
The revenue of the District ALR program shall be derived from such sources as may be approved by the District ALR Executive Committee in accordance with District policy.
C - POST
Section 1. The revenue of the Chapter shall be derived from such membership fees or dues and from such other sources as may be approved by the Chapter Executive Committee.
Section 2. The amount of such membership or initiation fees and the amount of such annual Chapter dues shall be fixed and determined by the Chapter.
Section 3. The Chapter shall provide a monthly activities and financial report to the sponsoring Post Finance officer.
Section 4. The sponsoring Post Finance Officer shall be listed on ALL accounts and shall assume and discharge the duties of the Chapter Treasurer in the absence of, or the vacancy of, said office.
Section 5. All disbursing of funds shall require two (2) signatures. The Post Finance Officer, Chapter Director and Chapter Treasurer are the only authorized signatures.
Section 6. All benevolent revenues raised, during the Legion year, shall be allocated with no less than fifty percent (50%) being dispensed towards Legion programs and/or projects at the Post, District, Department or National levels.
ARTICLE IX - State D.O.G. Rally
Section 1. The legislative body of the ALR shall be the State D.O.G. Rally to be held annually in concurrence with the Department Convention.
Section 2. In the State D.O.G. Rally each Department ALR Committee member shall be a delegate and entitled to one (1) vote.
Section 3. All past Department ALR Chairman shall be a delegate for life with one (1) vote.
Section 4. Each District ALR Committee shall be entitled to two (2) delegates with vote.
Section 5. Each Post ALR Chairman shall be a delegate and entitled to one (1) vote.
Section 6. Each Post Director shall be a delegate and entitled to one (1) vote.
Section 7. Each Post ALR shall be entitled to one (1) delegate with vote
Article X - Amendments
Section 1. This Department Constitution is adopted, subject to the provisions of the National Constitution, and the Department Constitution, of which this program is subordinate. Any amendment to the National, or Department Constitutions that is in conflict with any provision hereof shall be regarded as automatically repealing or modifying the provisions of the Constitution and Bylaws of this program to the extent of such conflict.
Section 2. This Department ALR Constitution may be amended at any State D.O.G. Rally meeting by a vote of two thirds (2/3) of the total authorized representation thereat, provided that the proposed amendments shall have been submitted through the appropriate Post, District, and Department ALR Committees in writing at least thirty (30) days prior to the convening of the next State D.O.G Rally meeting; provided , however, it may be amended by a unanimous vote at any State D.O.G. Rally meeting without prior notice.
Section 3. This Post ALR Constitution is adopted, subject to the provisions of the National, Department, District, and Post Constitutions, of which this Program is subordinate. Any amendment to the National, or Department Constitutions that is in conflict with any provision hereof shall be regarded as automatically repealing or modifying the provisions of the Constitution and Bylaws of this program to the extent of such conflict.
Section 4. This Post ALR Constitution may be amended at any regular Post ALR meeting by a vote of two thirds (2/3) of the members of said Post ALR attending such regular meeting, provided that the proposed amendment shall have been submitted in writing and read at the preceding regular meeting. Any changes will be reported to the sponsoring Post, District, and Department.
Section 5. Written notice to the addresses of record shall have been given to all members at least ten (10) days in advance of the date when such amendment is to be voted upon, notifying said members that at such meeting there will be presented a proposal to amend the Post ALR Constitution.

Article I - Name
Section 1. The Post ALR existing under these By-Laws is to be known as The American Legion Riders of Georgia Joseph N. Neel, Jr. American Legion Post 3.
Section 2. The name and nature of this program are set forth in the Constitution.
ARTICLE II - MANAGEMENT
A – DEPARTMENT
Section 1. Between Department Conferences and Conventions all administrative power shall be vested in the DOG ALR Executive Board.
Section 2. All DOG ALR Executive Board members shall be Legionnaires.
B – DISTRICT
Between District Conferences all administrative power for the District shall be vested in the District Executive Committee.
C – POST CHAPTER
Section 1. Between Chapter meetings, the administrative power of the Chapter shall be vested in the Chapter Executive Committee, which shall consist of all elected officers for the current year and the immediate Past Director.
Section 2. Officers of a Chapter shall be elected and installed annually in conjunction with the sponsoring Posts elections and installation, and take office at the next meeting following installation.
Section 3. All vacancies existing in any Executive Committee position or Office of the Chapter from any cause other than the expiration of the term shall be filled by a majority vote of the Chapter Executive Committee and with the consent of the Chapter Membership. This individual shall hold office for the unexpired term of the member of the Executive Committee or Officer whose position was vacated.
Section 4. A vacancy shall exist when a Committee member or officer is absent from the Chapter due to resignation, loss of qualifications, incapacity from injury or illness, or for a continuous period of three (3) unexcused absences.
Section 5. All replacement officer elections outlined in Section 3 are not valid until approved by vote of the Post general membership or by the Post executive committee. These new officers may also be installed by a Post official.
ARTICLE III - MEETINGS
A – DEPARTMENT
Section 1. The regular meetings of the DOG ALR Board shall be held in accordance with Department policy.
Section 2. The regular meetings of the DOG ALR Executive Committee shall be held in conjunction with the Department Conferences, and at the Department Convention.
Section 3. The DOG ALR Director shall have the authority to call a special meeting of the DOG ALR Executive Committee at any time. The DOG ALR Director shall call a special meeting of the DOG ALR Committee upon written request of a majority of the DOG ALR Executive Committee.
Section 4. Nine (9) members shall constitute a DOG ALR Executive Committee quorum.
Section 5. The immediate past DOG ALR Director shall have voice and vote at the DOG ALR Executive Committee meetings.
B - DISTRICT
Section 1. The regular meeting of the District ALR Executive Committee shall be held quarterly in conjunction with the District meetings and in accordance with District policy.
Section 2. The District ALR Director shall have the authority to call a special meeting of the District ALR Executive Committee. The District ALR Director shall call a special meeting of the District ALR Executive Committee upon written request of a majority of the District ALR Executive Committee.
C - POST
Section 1. The regular meeting of the Post ALR shall normally be held at 5:30 P.M. on the fourth Tuesday of each month at the Post 3, (which will occur prior to the Post 3 Monthly Meeting) to conduct such business as may properly be brought up for action.
Section 2. The Chapter ALR Director or a majority of the Chapter Executive Committee shall have authority to call a special meeting of the Chapter at any time.
Section 3. Upon the written request of a majority of the Chapter ALR members, the Chapter ALR Director shall call a special meeting of the Chapter.
Section 4. Special meetings must address a specific issue or issues and are not intended to replace the regularly scheduled monthly meeting.
Section 5. Five (5) members shall constitute a Chapter ALR quorum.
ARTICLE IV - CHAPTER ALR EXECUTIVE COMMITTEE
Section 1. The Chapter Executive Committee shall meet at the call of the Chapter Director within ten (10) days after the installation of new officers. Thereafter the Chapter Executive Committee shall meet as often as the Chapter Director may deem necessary. The Chapter Director shall call a meeting of the Chapter Executive Committee upon the joint request of three (3) or more members of said Chapter Executive Committee. Five (5) members of the Committee shall constitute a quorum thereof.
Section 2. The Chapter Executive Committee, based on majority vote shall authorize and approve all expenditures. The Chapter Executive Committee shall have charge of and be responsible for the management of the affairs of the Chapter.
ARTICLE V - DUTIES OF CHAPTER ALR OFFICERS
Section 1. Duties of Director. It shall be the duty of the Director to preside at all meetings of the ALR Chapter and to have general supervision over the business and affairs of the ALR Chapter, and such officer shall be the Chief Executive Officer of the ALR Chapter. The Director shall approve all orders directing the disbursement of funds and shall provide a monthly report covering the business and finances of the Chapter at each regular meeting of the hosting American Legion Post. The Director will insure that an annual report covering the business of the ALR be submitted for inclusion in the annual Consolidated Post Report. The Director is the chair of the ALR Chapter Executive Committee.
Section 2. Duties of Assistant Director. The Assistant Director shall assume and discharge the duties of the office of Director in the absence or disability of, or when called upon by the Chapter ALR Director. The Assistant Director will be responsible for membership, maintain accurate records of all ALR Chapter members, and render reports of membership monthly and annually to the ALR Chapter membership. The Assistant Director will serve as Chairman of the ALR Membership Committee and be responsible for Chapter membership information and the reviewing of the eligibility of new, renewing, and reinstatement of Chapter memberships. The Assistant Director is the vice chair of the Chapter Executive Committee with voice and vote.
Section 3. Duties of the Treasurer. To receive all moneys, to keep a just and true account of same and pay them out on the order of the ALR Chapter membership, with the consent of the ALR Director. The Treasurer will, in a timely manner, deposit all funds in the banking institution of choice approved by the ALR Chapter membership. The Treasurer will ensure two signatures on all checks disbursing Chapter funds. The Treasurer will serve as Chairman of the Finance Committee and give a detailed report at each Chapter regular membership meeting, and shall report once a month to the Chapter Executive Committee the condition of the finances of the Chapter. The Treasurer shall also prepare a monthly activities and financial report for the sponsoring Post Executive Committee. The Treasurer will also be keeper of the Chapter store. The Treasurer is a member of the Chapter Executive Committee with voice and vote.
Section 4. Duties of the Secretary. The Secretary shall keep a full and correct account of the proceedings of the ALR Chapter Executive Committee meetings, and all Chapter membership meetings. The Secretary will also make available a written copy of the minutes at each Chapter regular meeting, and keep such records as the sponsoring Post, District, and Department may require. The Secretary shall, under direction of the ALR Chapter Director, handle all correspondence of the Chapter. The Secretary is a member of the ALR Chapter Executive Committee with voice and vote.
Section 5. Duties of the Sergeant-at-Arms. The Sergeant-at-Arms shall ensure meeting areas are prepared in advance for all ALR Chapter meetings. The Sergeant-at-Arms will ensure eligibility of all members attending such Chapter meetings, and preserve order at all Chapter meetings and gatherings. The Sergeant-at-Arms will assist the ALR Director in all Chapter activities and perform such other duties as may be incumbent upon the office or assigned by the Director. The Sergeant-at-Arms is a member of the ALR Chapter Executive Committee with voice and vote.
Section 6. Duties of Road Captain. The Road Captain shall plan and lead the formation in all organized tours, runs, activities, parades, events and enforce all rules of safe motorcycle operation and group riding. The Road Captain, at any time, may appoint Assistant Road Captains to aid in special tasks or take any other measures necessary to help insure the safety of the group during a ride. The Road Captain will serve as a member of the Activities Committee.
Section 7. Duties of the Activities Officer. The Activities Officer shall be the logistics person in charge of all Chapter functions, and arouse interest in them. The Activities Officer will serve as Chairman of the Activities Committee and determine dates, times and meeting places for those taking part in Chapter functions. The Activities Officer must make available a written copy of the Chapter functions, prior to the event, to its membership, Post, District, and Department as may be required, and perform such other duties as may properly pertain to the office as may be determined by the Director.
Section 8 Duties of the Safety Officer. The Safety Officer shall work closely with the Road Captain and Sergeant-at-Arms to maximize the safety of all participants at all events. The Safety Officer shall also prepare and present safety training or a safety tip to the membership at every regular meeting. The Safety Officer will assist the Road Captain and the Treasurer with event planning and event insurance issues. The Safety Officer shall perform other such duties as directed by the Director, and Chapter Executive Committee.
Section 9. Duties of the Judge Advocate. The Judge Advocate shall advise the Chapter Officers and Membership of all matters concerning interpretation of parliamentary procedure “Roberts Rules of Order” and adherence to The American Legion Constitution and By-Laws for the National, Department, District, and Post organizations. The Judge Advocate shall also advise on matters concerning interpretation of The Department of Georgia American Legion Riders, and Chapter Constitutions and By-Laws. Further, this officer will maintain a file of the current editions of the above-cited documents.
Section 10. Duties of the Chaplain. The Chaplain shall be charged with the spiritual welfare of the Chapter and will offer divine but nonsectarian service in the event of dedications, funerals, and public functions, etc., and adhere to such ceremonial rituals as are recommended by the National or Department headquarters from time to time.
Section 11. Duties of the Historian. The Historian shall preserve the records, incidents, and archives of the Chapter and publish from time to time such historical data as may be appropriate. The Historian shall perform such other duties as may properly pertain to the office as may be determined by the Director or Executive Committee.
ARTICLE VI - DELEGATES
Section 1. Department/District delegates and their alternates shall be appointed in accordance with Department/District policy.
Section 2. Post ALR delegates and alternates to the State D.O.G Rally, or Department ALR meeting, convention, regional gathering or other activity shall be elected by the Post ALR membership at a regular meeting of the Post ALR to be held prior to the date of such event.
ARTICLE VII - CHAPTER COMMITTEE APPOINTMENTS
Section 1. Three (3) standing committees; Membership, Finance, and Activities are established with the chairperson of each being the officer as assigned in ARTICLE IV, DUTIES OF ALR CHAPTER OFFICERS.
Section 2. Additional committees shall consist of such persons, and the Chair thereof, as designated by the ALR Director. The duties and length of service of these committees shall be stated at the time the committee is appointed.
ARTICLE VIII - SUPPORTERS
Section 1. Membership as an ALR Chapter Supporter is open to all members of American Legion Post 3 (hereafter referred to as parent organization) Legionnaires, Auxiliary, and Sons members in good standing and who actively participate.
ARTICLE VIX – RESOLUTIONS
All resolutions of Department or National scope presented to the Chapter by a member or reported to the Chapter by a committee shall merely embody the opinion of the Chapter on the subject and a copy of same shall be forwarded to the Post/Department headquarters for its approval before any publicity is given or action other than mere passage by the Chapter is taken.
ARTICLE X – NOTICES
Section 1. Every member shall furnish the Chapter Secretary with a valid email or postal mailing address.
Section 2. The Chapter Secretary shall cause notice of the annual election to be given at least two (2) weeks prior thereto.
ARTICLE XI – PARLIAMENTARY PROCEDURE
The rules of procedure as prescribed by the revised edition of Robert’s Rules of Order shall be the accepted standard of parliamentary practice in all ALR meetings so far as the same are consistent with this Constitution and By-Laws and with such other specific rules as may be adopted for each meeting.
ARTICLE XII - LIMITATIONS OF LIABILITIES
Section 1. The Chapter shall incur, or cause to be incurred, no liability nor obligation whatever which shall subject to liability any other Chapter, subdivision, members of The American Legion, Department, District, Post, or other individuals, corporations or organizations.
Section 2. The Chapter shall take such steps necessary to secure appropriate event insurance for all organized rides, events, celebrations and functions undertaken under the name of the hosting Post or Department.
ARTICLE XIII - AMENDMENTS
Section 1. These DOG ALR By-Laws are adopted, subject to the provisions of the National By-Laws, and Department By-Laws, of which this Program is subordinate. Any amendment to the National, or Department By-Laws that is in conflict with any provision hereof shall be regarded as automatically repealing or modifying the provisions of the By-Laws of this Program to the extent of such conflict.
Section 2. These By-Laws may be amended at any Department Convention by a vote of two-thirds (2/3) of the total authorized representation thereat, provided the proposed amendments shall have been submitted through the Department Adjutant to the several Posts and members of the Department Executive Committee by mailing, proposed amendments to them at least thirty (30) days prior to the convening of the next Department Convention; provided, however, it may be amended by a unanimous vote at any Department Convention without prior notice.
Section 3. No proposed amendment shall be submitted through the Department Adjutant to the several Posts and members of the Department Executive Committee or considered by the Department Convention unless the same shall have first received the formal endorsement of the sponsoring Post and District. Such resolution must be presented to the DOG ALR Executive Board sixty days (60) prior to the convening of the next Department Convention.
